Terms and Conditions of Contract

By agreeing to purchase a Vartour virtual tour you agree to the following terms and conditions.

The term ‘Vartour’ or ‘us’ or ‘we’ refers to the virtual tour photography service provider illustrated in this website. The term ‘Client’ refers to the purchaser of services from Vartour.

AGREEMENT OVERVIEW This agreement contains the entire understanding between Vartour and the Client. It supersedes all prior and simultaneous agreements between the parties.

SERVICE AGREEMENT This confirms the contracting agreement: I agree that Vartour shall provide services to photograph the Client’s business premises to the best of Vartour’s abilities in accordance with the package selected. Every effort will be made to assure your satisfaction according to industry standards. Any artistic interpretation by the photographer will be deemed acceptable and correct. Due to the nature of the business, all sales are final. Although every care possible will be taken to produce photographs of all important areas of your premises, the Photographer cannot place an unconditional guarantee on the above. If you are not satisfied with your images through fault of Vartour your images will be retaken. Notification of dissatisfaction must be received in writing within 10 days of the photos being uploaded to Google. We do all we can to ensure that you are satisfied with your images. We cannot be responsible for dissatisfaction due to circumstances beyond our control.

COOPERATION The parties agree to cheerful cooperation and communication for the best possible result within the definition of the assignment. Vartour is not responsible for missed images due to details not revealed to Vartour prior to or during the photography shoot. Vartour shall use its own judgment regarding style and input in the production of pictures. This includes but is not limited to locations and number of images taken.

IMAGES, VIDEOS AND COPYRIGHTS Photographs/images and videos produced by Vartour are protected by Copyright Law. Upon full payment by the Client, the Client is granted limited license to use and or display the resulting images as per the Google Maps/Google Earth Terms of Service. Said images and videos may not be altered or used in any manner outside what is prescribed in this document without prior written permission of Vartour. The Client must obtain written permission from and compensate Vartour prior to the Client or its associates re-distributing or selling the photographs or videos for any reason not prescribed in this document.

MODEL RELEASE The Client hereby grants to Vartour the irrevocable and unrestricted right to use and publish photographs of the Client’s business premises in which the Client may be included for the promotion of its business and services, including editorial, trade, advertising and any other purpose and in any manner and medium.

LIMIT OF LIABILITY In the unlikely event that the photographer is injured or becomes too ill, or has an extreme emergency that prevents them from photographing the virtual tour, Vartour will make every effort to reschedule the photo shoot. If for whatever reason this is not possible, responsibility and liability is limited to the rescheduling, or return of all payments received for the virtual tour package purchased. Vartour takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond Vartour’s control, Vartour’s liability is limited to the return of all payments received for the virtual tour package.

COVERAGE The Client understands and accepts that the photographic coverage will be as our professional expertise determines and that not one photograph be deemed more important than another. Every effort will be made to comply with your wishes. Any additional requests not notified to Vartour prior to the photoshoot must be made by the Client in writing.

PHOTOGRAPHS AND RETOUCHING Any photograph viewed are individually corrected for colour balance, density, contrast, etc. All photographs that are used in the virtual tour will receive individual attention in the form of retouching, enhancement, selective area adjustment, textures, etc as deemed necessary by Vartour. Retouching means correcting various elements in an image such as litter, distractions and minor flaws. Vartour is granted total artistic control over the final image and the Client understands that these are the steps Vartour will take when referring to retouching.

STITCHING ERRORS The complex process of creating 360° photographs may create small stitching errors in the final image. These are observed as small tears in random areas of the image. Where practicable these stitching errors will be removed, though some small errors may persist. By agreeing to purchase a Vartour virtual tour you understand that there may be unavoidable stitching errors in the final delivered images.

REVISIONS Any photograph or feature of the virtual tour will be revised by Vartour to the Client’s satisfaction up to 10 days after the final deliverable is submitted to Google Maps. Revisions will be completed only as deemed reasonable or necessary by Vartour.

VIRTUAL TOUR HOSTING The Client’s delivered virtual tour will be hosted online via Google servers. If Vartour ceases to trade, all original images will remain on Google servers. If requested, Vartour will submit a request to remove all Client images that Vartour uploaded to Google.

CANCELLATION If Vartour has to cancel the photoshoot for reasons beyond their control and the contract has to be completely cancelled their liability is limited to a full refund of all monies paid to us.

PAYMENT SCHEDULE The Client shall pay 100% of the full agreed virtual tour fee before Vartour begins the photo shoot.

PAYMENT Please make payments to Vartour for the full invoice amount for the agreed virtual tour package via the PayPal payment service. Payment can be made via the PayPal mobile app or website. Payments to Vartour via PayPal can be made using email address mail@vartour.com or paypal.me/vartour.
